Appeals authority restores name of CA guilty of professional misconduct to membership register
Under the provisions of Article 21B(3) of the Chartered Accountants Act, 1949 read with Chartered Accountants Rules 18(17) and 19(1) (Procedure for Investigation of Professional and Other Misconduct and Conduct of Business) Rules, 2007, the Discipline Committee found CA. Abraham Zachariah (Member No. 024413), 103, Prince Residency, 20, Sterling Road Avenue, Nungambakkam, CHENNAI 600 034, guilty of professional misconduct within the meaning of clauses (2) and (7) of Part I of the Second Schedule to the said law and accordingly ordered the deletion of the name of the said CA. Abraham Zachariah (member no. 024413) from the register of members for a period of 01 (one) year.
Thereunder and in exercising the powers conferred by subsection (2) of section 20 of the above Act, read together with Regulation 18 of the Chartered Accountants Regulations, 1988, the name of the said CA. Abraham Zachariah (member number 024413) has been removed from the register of members for a period of 01 (one) year from January 11, 2022. Agreed by the order of the committee, the defendant preferred to appeal under the section 22G of the Chartered Accountants and Appellate Authority Act 1949 seeing that his order made on 17th August 2022 varied the quantum of the sentence to the period already served by the appellant and also ordered the immediate restoration of the caller’s name in the membership register. Accordingly, pursuant to said order of the Appeals Authority, the notification dated January 11, 2022 in which the name of CA. Abraham Zachariah (member number 024413) has been deleted for a period of 01 (one) year is hereby amended insofar as his name is deleted until August 16, 2022 only.
